1. About these terms
These terms govern your use of the website at https://sigmadelta.com.br, operated by Sigma Delta Engineering LLC. By using the site you accept them. Engineering services are delivered under a separate signed proposal or master services agreement; where that document conflicts with these terms, the signed document prevails.
2. Permitted use of this website
- You may view, download and print pages for your own business evaluation of our services.
- You may not scrape, mirror, resell or republish substantial portions of the site.
- You may not attempt to gain unauthorised access, probe for vulnerabilities, or interfere with availability for other visitors.
- You may not misrepresent yourself when submitting an enquiry, or send us content you have no right to disclose.
3. Accuracy of information
We prepare the content of this site carefully, but it is general information about our capabilities. Prices shown are indicative planning ranges, not offers, and firm pricing follows a site assessment. Timelines, results and figures from past projects describe those projects and are not a promise of similar outcomes. Nothing on this website constitutes engineering advice for your specific installation, and no engineer-client relationship is created until a written agreement is signed.
4. Intellectual property
The Sigma Delta name, logo, page copy, layout, photography and code on this site are owned by Sigma Delta Engineering LLC or used with permission. Trademarks of automation platforms mentioned on this site (for example Rockwell Automation, Siemens, Omron, Beckhoff, FANUC, Ignition) belong to their respective owners; we reference them to describe our experience and claim no affiliation, endorsement or authorised-reseller status unless stated in writing.
5. Ownership of project deliverables
Under our standard engagement terms, on full payment the client receives ownership of the project-specific deliverables: application programs, configuration, drawings, tag databases and documentation prepared for that project. We retain ownership of our pre-existing libraries, templates and know-how, and grant the client a perpetual, non-exclusive licence to use them as embedded in the deliverables.
6. Enquiries and confidentiality
Information you send through the contact form or by email is treated as confidential business information and used only to respond to your enquiry. Please do not send trade secrets, controlled technical data or personal information about third parties before an NDA is in place; we are happy to sign one first.
7. Third-party links and embeds
This site links to external websites and embeds a map from OpenStreetMap. We do not control those services and accept no responsibility for their content, availability or practices.
8. Availability
We aim to keep the site available continuously but do not guarantee uninterrupted access. We may change, suspend or withdraw any part of the site, and may update these terms; the current version is always the one published on this page.
9. Limitation of liability
To the fullest extent permitted by law, the website and its content are provided "as is" without warranties of any kind. We are not liable for indirect, incidental or consequential loss arising from use of this website, or from reliance on general information published here rather than on written engineering advice provided under contract. Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or personal injury caused by negligence.
10. Your responsibility
You agree to indemnify us against claims arising from your misuse of this website or from content you submit through it in breach of these terms.
11. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in Santa Clara County, California have exclusive jurisdiction over disputes relating to this website. Where a signed services agreement specifies a different dispute mechanism, that mechanism applies to the services.
12. General
If any provision is found unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy and Cookie Policies, form the complete agreement regarding use of this website.
